The Panel ordered the transfer of the domain name to the Complainant after finding that all three elements of the UDRP were satisfied.
First, the Panel held that the domain name is confusingly similar to the Complainant’s registered BETMASTER trademark. The mark is fully incorporated in the domain name, and the addition of the geographic term “estonia” does not prevent consumer confusion.
Second, the Panel found that the Respondent, had no rights or legitimate interests in the domain name. The Respondent was not authorized to use the BETMASTER mark, was not affiliated with the Complainant, and failed to submit any response or evidence establishing legitimate use. The associated website misleadingly used the Complainant’s branding and did not meet recognized reseller or fair-use standards.
Third, the Panel concluded that the domain name was registered and used in bad faith. The Respondent had clear knowledge of the BETMASTER mark, used the Complainant’s logo, and operated a site that redirected users to a competing gambling platform for commercial gain, intentionally exploiting consumer confusion.
Accordingly, the Panel ordered the transfer of the domain name to the Complainant.
